Late rent notice and notice to pay rent or quit

By the BizDocs Studio team · Updated

Key points
  • •A late rent notice is a friendly written reminder after the grace period; a notice to pay rent or quit is the formal statutory notice that starts the eviction clock.
  • •Pay-or-quit periods are set by state law (commonly 3, 5, 10 or 14 days) and some states prescribe wording and delivery.
  • •State only rent in the pay-or-quit amount where your state requires it; list late fees separately.
  • •Keep a rent ledger so every notice is backed by a dated record.

Most late rent is solved by a polite reminder. The formal notice exists for the rest, and it must be done exactly right, because a defective notice can restart the whole process.

Step 1: the late rent notice

Send it the day after the grace period ends. State the rent due, the late fee under the lease, the total and how to pay, and invite the tenant to call if something has changed. Tone matters; you want the payment, not a fight.

Sample wording

Our records show rent of $1,450 due on November 1 has not been received. A late fee of $50 applies under your lease, bringing the total to $1,500. Please pay by November 10 through the portal. If you have already paid, thank you, please send confirmation.

Step 2: notice to pay rent or quit

  • Tenant names and premises address
  • Amount of rent owed, by period
  • Deadline in days as set by your state, and how days are counted
  • Where and how to pay
  • Statement that legal proceedings may follow if neither payment nor move-out happens
  • Date, method of delivery and your signature

Delivery

States specify acceptable delivery: personal delivery, leaving with an adult and mailing, posting and mailing, or certified mail. Record the date and method; take a photo if posted. Electronic delivery counts only where state law and the lease allow.

Other common landlord notices

NoticeTypical use

Notice of entry24–48 hours before non-emergency entry
Non-renewal / terminationEnd of term or month-to-month, 30–60+ days

Our landlord pack includes all six notices in one file, with delivery tick boxes and a not-legal-advice footer, plus the rent ledger that supports them.

Grace periods and late fees

Some states set a mandatory grace period before a late fee can apply, and many cap the fee (for example a percentage of monthly rent). Your lease should state the due date, the grace period and the fee within those limits, and your notices should match the lease exactly.

Keep a rent ledger

Every notice should be backed by a dated record: rent charged, payments received, late fees and balance. A simple ledger per tenancy (date, description, charge, payment, balance) is what a judge or mediator will ask to see.

Payment plans before formal notices

For a good tenant with a one-off problem, a written payment plan often recovers more money, faster, than an eviction. Put the plan in writing with dates and amounts, and state what happens if a payment is missed.

After the notice period

If the tenant neither pays nor leaves, the next step is filing an eviction case in the proper court. Do not change locks, remove belongings or shut off utilities; self-help eviction is illegal in nearly every state.

Frequently asked questions

How many days' notice for unpaid rent?

It depends on the state; 3, 5, 10 and 14 days are all common, and some exclude weekends and holidays. Check your state statute before serving.

Can I include late fees in a pay-or-quit notice?

Some states allow only rent in the demand amount. List late fees separately unless your state allows them in the notice.

Can I accept partial rent after serving a notice?

In some states accepting partial payment waives the notice. Know your state's rule before accepting any money.
